Terms of Service for InfoArc LLC, a New Mexico Limited Liability Company.

Definitions

Because everyone (not just lawyers) should be able to easily understand how and why their information is collected and used, we use common language instead of more formal terms throughout this Policy. To help ensure your understanding of some particular key terms, here is a table of translations:

When we say…

… we mean:

“InfoArc” / “we” / “us” / “our”

InfoArc LLC., the New Mexico Limited Liability Company and sole proprietorship that operates https://infoarc.io and all other associated InfoArc Sites.

“InfoArc”/ “InfoArc Sites” / “our services”

InfoArc webSites and services (regardless of language), including our main projects, such as the InfoArc webiste, as well as mobile applications, APIs, emails, and notifications; excluding, however, Sites and services listed in the “What This Privacy Policy Doesn’t Cover” section below.

“you” / “your” / “me”

You, regardless of whether you are an individual, group, or organization, and regardless of whether you are using the InfoArc Sites or our services on behalf of yourself or someone else.

“this Policy” / “this Privacy Policy”

This document, entitled the “InfoArc Privacy Policy”.

“contributions”

Content you add or changes you make to any InfoArc Sites.

“personal information”

Information you provide us or information we collect from you that could be used to personally identify you. To be clear, while we do not necessarily collect all of the following types of information, we consider at least the following to be “personal information” if it is otherwise nonpublic and can be used to identify you:

(a) your real name, address, phone number, email address, password, identification number on government-issued ID, IP address, user-agent information, credit card number;

(b) when associated with one of the items in subsection (a), any sensitive data such as date of birth, gender, sexual orientation, racial or ethnic origins, marital or familial status, medical conditions or disabilities, political affiliation, and religion; and

(c) any of the items in subsections (a) or (b) when associated with your user account, except where you share this information in a public forum, homework assignment, or posting of any kind in a public forum on any InfoArc Site.

“third party” / “third parties”

Individuals, entities, webSites, services, products, and applications that are not controlled, managed, or operated by InfoArc. This includes other InfoArc users and independent organizations or groups who help develop, improve, or promote the InfoArc products such as study groups, associates, allied professionals and professional organizations, chapters, thematic organizations, and user groups as well as volunteers, employees, directors, officers, grant recipients, and contractors of those organizations or groups.

We recognize that only a minority of you are familiar with technical terms like “tracking pixels” and “cookies” used in the Privacy Policy. Whether you are brand new to privacy terminology or you are an expert who just wants a refresher, you might find our Glossary of Key Terms helpful.

Acceptance of Terms

By accessing and using the website https://infoarc.io (the "Site"), or systems and services provided under contract by InfoArc, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the Site or services.

Services Provided

The Site provides information and resources related to your account with InfoArc LLC or services provided under contract by InfoArc LLC. . This includes account updates, event information, payment processing, communication channels and general resources.

User Obligations

As a user of the Site, you agree to:

- Use the Site in accordance with these terms and all applicable laws.

- Provide accurate information when requested, such as for forms or payments.

- Not engage in any activity that disrupts or interferes with the proper functioning of the Site or user accounts other than your own that are provided on the Site.

Account Registration

Some parts of the Site may require you to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Payment Processing

The Site may offer online payment options. By making a payment through the Site, you agree to provide accurate payment information and authorize InfoArc to charge the applicable fees to your payment method.

Intellectual Property

All content, including text, graphics, logos, and images, provided on the Site is the property of InfoArc LLC. and is protected by copyright and trademark laws.

Usage Restrictions:

Users shall not use the Site for any unlawful or unauthorized purpose, including but not limited to hacking, spamming, or data scraping.

Termination

We reserve the right to terminate or suspend your access to the Site at our discretion, without notice, for conduct that violates these Terms of Service or any applicable laws.

Indemnity and Limitation of Liability

Members and Users will indemnify and hold harmless InfoArc LLC and its, affiliates and subsidiaries, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by InfoArc to transmit and distribute materials, from any and all liabilities, damages, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims alleging conduct that would amount to a breach of any of Company’s representations and warranties in the Membership Agreement, including these Terms and Conditions.

InfoArc shall not be liable to members for any indirect, incidental, consequential, special or exemplary damages (even if InfoArc has been advised of the possibility of such damages), arising from or related in any way to any provision of this agreement (including such damages incurred by third parties), including but not limited to loss of revenue or anticipated profits or lost business. In no event shall InfoArc be liable to member for an amount greater than the payments made by member to infoarc for products and services provided pursuant to the terms of this agreement. Some jurisdictions do not allow the exclusion of liability for incidental or consequential damages, so some or all of the above exclusions or limitations may not apply.

Governing Law

These Terms of Service are governed by the laws of New Mexico, without regard to its conflict of law principles.

Changes to These Terms

We may update these Terms of Service from time to time. Any changes will be posted on this page with an updated effective date.
